for the free evaluation version

Andrei Grigoriev (LICENSOR) hereby grants to you (LICENSEE) the non-exclusive and non-transferrable right to use the free evaluation version of crossword applets (SOFTWARE) in machine-readable form, subject to terms and conditions of this AGREEMENT and LICENSEE hereby accepts such license solely upon these terms and conditions.

The SOFTWARE is copyrighted and title, ownership rights, and intellectual property rights to all copies are retained by LICENSOR.

LICENSEE may terminate this license at any time by destroying all copies of the SOFTWARE including documentation.

This license shall also terminate thirty (30) days after notice from LICENSOR to LICENSEE that LICENSEE is in breach of this AGREEMENT unless within that time LICENSEE gives notice satisfactory to LICENSOR that such breach has been corrected. Upon termination, LICENSEE shall immediately destroy all copies of the SOFTWARE including any copies contained in any storage apparatus or medium and shall cease use thereof.

LICENSEE shall not make copies of the SOFTWARE, other than a single copy for archival purposes. LICENSEE shall not modify, decompile, disassembe, decrypt, extract or otherwise reverse engineer the SOFTWARE.

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND FREEDOM FROM INFRINGEMENT. LICENSOR SHALL NOT BE LIABLE FOR ANY DAMAGES SUFFERED BY LICENSEE OR ANY OTHER USER AS A RESULT OF USING, OR INABILITY TO USE, THE SOFTWARE OR ITS DERIVATIVES. THIS SOFTWARE IS NOT DESIGNED OR INTENDED FOR USE OR RESALE AS ON-LINE CONTROL EQUIPMENT IN HAZARDOUS ENVIRONMENTS REQUIRING FAIL-SAFE PERFORMANCE, SUCH AS IN THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, DIRECT LIFE SUPPORT MACHINES, OR WEAPONS SYSTEMS, IN WHICH THE FAILURE OF THE SOFTWARE COULD LEAD DIRECTLY TO DEATH, PERSONAL INJURY, FINANCIAL LOSS, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE ("HIGH RISK ACTIVITIES").
